DMCA / Copyright Policy

1. Our policy

Simfile respects the intellectual property rights of others and expects users to do the same. It's our policy to respond to clear notices of alleged copyright infringement that follow the notice-and-takedown process described in the U.S. Digital Millennium Copyright Act (DMCA), which we use as a general standard even for complaints originating outside the United States.

2. Filing a copyright complaint

If you believe a file hosted on Simfile infringes your copyright, send a notice to contact@simfile.co that includes:

  1. your physical or electronic signature, and contact information (name, email, and address);
  2. identification of the copyrighted work you claim has been infringed;
  3. the download link or file code on Simfile that you claim is infringing, so we can locate it;
  4. a statement that you have a good-faith belief that the use isn't authorized by the copyright owner, its agent, or the law; and
  5. a statement, made under penalty of perjury, that the information in your notice is accurate and that you're the copyright owner or authorized to act on their behalf.

Incomplete notices may take longer to process or may not result in removal.

3. What happens after a valid notice

Once we receive a notice that reasonably meets the requirements above, we'll disable access to the file and notify the uploader. Removed files are marked as taken down and are no longer available for download.

4. Filing a counter-notice

If your file was removed and you believe this was a mistake or misidentification, you may send a counter-notice to contact@simfile.co that includes:

  1. your physical or electronic signature;
  2. identification of the file that was removed and its location before removal;
  3. a statement, under penalty of perjury, that you have a good-faith belief the file was removed as a result of mistake or misidentification; and
  4. your name, address, and phone number, and a statement that you consent to the jurisdiction of a court to resolve the dispute with the person who filed the original notice.

We may share a valid counter-notice with the original complainant. Unless they inform us they've filed a court action against you, we may restore the file after a reasonable waiting period.

5. Repeat infringers

We may suspend or terminate the accounts of users who are found to repeatedly infringe copyright, in accordance with our Terms of Service.
